The purpose of this document is to inform our clients of the terms and conditions of operation of YOUHOMEY. The conditions of contracting our services will be defined in a contract document that will be signed between clients and YOUHOMEY, and that will expand and detail some of the points set out here. Where there is controversy, the signed contractual conditions will prevail. For this reason, this document will focus on explaining the conditions and the procedure for contracting the service. These conditions will apply to all distribution channels in which YOUHOMEY is advertised.

1.- CONTRACTING PROCEDURE

This document will be public so that the client has easy access to the information.

The contracting procedure will be considered to begin at the moment in which the client contacts YOUHOMEY by telephone, email or on portals where YOUHOMEY advertises, and the privacy policy will apply from that precise moment.

YOUHOMEY considers both owners and tenants to be clients, therefore, both will be treated in the same way at different times during their relationship with YOUHOMEY.

YOUHOMEY provides its clients with a database of accommodations with extensive information and a photo report, videos, floor plans, virtual tour, aimed at helping the tenant to find the most suitable accommodation. All the information offered (descriptions, photos, characteristics, services and availability) belongs to YOUHOMEY, and is made available to clients solely for their evaluation. This information may be shared by the client with other people under the same conditions and only through sharing links to our pages.

The rental prices of the apartments on the YOUHOMEY website are indicative, they may vary depending on the time of year or the conditions of the application and contracting. The offer with the prices offered during the negotiation period expire in 24 hours. They can only vary if the reservation payment has been made and the conditions on which the offer was based do not change.

1.1.- Reservation procedure

YOUHOMEY establishes a reservation method in which information is requested from the client for the preparation of the reservation contract, which is signed through a digital signature and will also be informed by our agents before making any payment.

YOUHOMEY establishes the payment of a reservation. This payment must be made in order to receive confirmation that the apartment is already reserved. The amount of the reservation may be different for each apartment and period and must be consulted with the sales representative in charge of the apartment.

1.2.- Payment and collection methods

For online payment, YOUHOMEY uses secure card payment procedures using processes provided by Caixabank through Sermepa/Redsys, which are integrated into our portals. You can consult the information about this provider at http://www.redsys.es

YOUHOMEY has different on-line payment systems, by credit card, STRIPE and bank transfer, the customer being the responsibility of all financial expenses that such payments entail.

1.3.- Reception of contract and remaining income

YOUHOMEY will send the client contracts for digital signature, where the payment method and subsequent rents to be paid during the temporary contract are specified. YOUHOMEY provides a help center within the website where we answer the most frequently asked questions.

If the apartment is managed by YOUHOMEY or belongs to YOUHOMEY, the reservation, entrance and periodic payments will be made to YOUHOMEY directly.

1.4.- Payment of administration expenses

In all cases of seasonal rental contracts, YOUHOMEY charges a fee based on the square meters of the property. This fee will only be charged if the client finally formalizes the reservation contract.

Administration fees will be charged to the client each time a reservation contract is formalized. WITHOUT EXCEPTION.

1.5.- Change policy

YOUHOMEY cannot guarantee the availability of an apartment due to the client's request for change of dates.

1.6.- Cancellation and / or no-show policy

The amount of the reservation is not refundable in case of cancellation.

1.7.- Time of entry and exit in the apartments

The client is obliged to communicate his arrival time at the apartment at least 2 days in advance. Given the different locations of the accommodations, YOUHOMEY does not guarantee the presence of its agent at the entrance of the apartment if the client does not provide this information.

YOUHOMEY establishes a mandatory check-out time from the apartment before 12 noon.

YOUHOMEY will only deliver the keys at no additional cost during business hours from Monday to Friday from 10:30 a.m. to 18:XNUMX p.m. Any entry to the apartments outside of these hours will have an additional cost which will be:

From Monday to Friday from 8:00 a.m. to 9:30 a.m. and from 19:30 p.m. to 21:00 p.m. €25.

From Monday to Friday from 22:30 p.m. to 6:00 a.m. for €50

Saturdays, Sundays and Holidays 50€.

This fee must be paid in cash to the salesperson at the time of Check-In.

At the time of Check-In Youhomey will verify that the agreed payments must be in the account, in case the payments are not confirmed, 2 hours before the agreed appointment, it will be automatically cancelled.

For DEPARTURES, the TENANT must leave the keys inside the house, making sure to close the entrance door of the house. In case of non-compliance there is a penalty of €500.

2.- DURING YOUR STAY.

2.1.- Rent payment

Monthly rents must be paid from the 1st to the 5th of the month. In case of late payment, a penalty of €200 for each day of delay will be applied as stipulated in the contract.

For contracts that do not start on the first day of the month, the amount paid will be the proportional days of the month from the start of the contract plus the rent for the following month. Example: if your contract starts on October 15, you must pay 16 days of October plus the rent for the month of November. In the following months you will pay the full rent as agreed in your contract.

2.2.- Hosted people

YOUHOMEY does not allow overnight stays in the home of persons who are not listed in the rental contract.

2.3- Rules of conduct

Our apartments are located in residential buildings. We demand that our guests behave appropriately. Don't make too much noise or make the music too loud. If the neighbors complain or if they have to call the police, you will have to vacate the apartment without the right to compensation or refund of the amounts paid for breach of contract. Remember that you are NOT allowed to carry out annoying or unhealthy activities, have parties or have pets without express authorization.

YOUHOMEY takes care of your apartments, they are cleaned before your arrival and after your departure. However, if the apartment is too dirty, we reserve the right to deduct from the Deposit / Deposit the amount necessary to cover the additional cleaning cost.

YOUHOMEY asks the TENANT to have good ventilation in the home, this to avoid humidity in it, in case evidence is found that this is not being done, it carries a penalty of €500.

2.4- Incidents in Housing.

The LESSEE shall be responsible for minor repairs due to wear and tear from ORDINARY USE. Minor repairs shall be those or replacement of elements of the property that meet the requirements established in Art. 21.4 of the LAU, and whose cost does not exceed 25% of the rent established in the lease agreement.

The TENANT must notify any incidents that exceed 25% of the rent established in the lease agreement, said incidents must be notified by clicking HERE. Any incidents that do not meet the requirements established in art. 21.4 of LAU will be ignored.

In the case of EMERGENCIES (considered as EMERGENCIES floods, fire and/or power outage), it must be notified by clicking HEREAny form that is not related to any of the situations mentioned above will be ignored.

3.- LEGAL

3.1.- Type of contract

YOUHOMEY offers its clients only a seasonal contract of use other than permanent housing.

This contract is governed by the will of the parties, failing which, by the provisions of Title III LAU 1994 and, additionally, by the provisions of the Civil Code (arts. 1, 2.1, 3 and 4.3 LAU). In any case, and in accordance with the provisions of art. 4.1 LAU, the common provisions contained in Title IV (bond and formalization of the lease) and in Title V (lease processes) of the LAU will be mandatory.

3.2.- Invoices

YOUHOMEY generates invoices for administration costs.

YOUHOMEY administers apartments of individuals who have no knowledge, capacity or interest in managing quarterly VAT returns and, therefore, do not accept business clients or self-employed clients who require an invoice and only admit individuals. It is the client's responsibility to inform in advance of their need for an invoice before making their reservation.

3.3.- Responsibilities

Neither YOUHOMEY nor the apartment owners will be liable for damages that may occur during your stay in the apartment, including without limitation, personal injury, death or loss, whether due to fire, theft or flood or due to action or the personal irresponsibility of the client, the unauthorized access of a person to the apartment or the misuse of the elements included in the accommodation.

In the event that you have a confirmed reservation and YOUHOMEY cannot accommodate you in the apartment of your choice, YOUHOMEY's responsibility will be limited to providing accommodation in an apartment with similar characteristics or to the full refund of the amounts paid.

At YOUHOMEY we strive to accurately describe our apartments. If any dispute arises regarding the description of the apartment, YOUHOMEY's responsibility will be limited to reimbursing the amounts paid, less the cost of the days spent, if you decide not to stay in the apartment.

3.4.- Conflict resolution

For any conflict over our services, Spanish law will be applied, from the Courts and Tribunals of Madrid, or the Madrid Court of Arbitration (Law 60/2003, of December 23, on Arbitration (BOE nº 309/12/2003) ).
