Terms and Conditions

The purpose of this document is to inform our clients of YOUHOMEY's terms and conditions of operation. The contracting conditions of our services will be defined in a contract document that will be signed between clients and owners, and in some cases by YOUHOMEY, and that will expand and detail any of the points set out here. Wherever there is controversy, the signed contractual conditions will prevail. It is for this reason that this document will focus on explaining the conditions and the procedure for contracting the service. These conditions will only apply to own channels and not to third party agencies and internet portals not belonging to YOUHOMEY.

1.- CONTRACTING PROCEDURE

This document will be public so that the client has easy access to the information.

It will be considered that the contracting procedure begins at the same time that the client contacts YOUHOMEY through the telephone, email or our own internet portals, applying the privacy policy from that precise moment.

YOUHOMEY considers clients both landlords (owners, managers) and tenants (individual and collective clients) and, therefore, said treatment will be applied to both at different times of their relationship with YOUHOMEY.

YOUHOMEY offers its clients a database of accommodation with extensive information and a photographic report aimed at helping the tenant-client to find the most suitable accommodation. All the information offered (descriptions, photos, characteristics, services and availability) belongs to YOUHOMEY, and is made available to clients solely for their evaluation. This information can be shared by the client to other people under the same conditions and only through the sharing of links to our pages.

The rental prices of the apartments on the YOUHOMEY website are indicative, they may vary depending on the time of year or the conditions of the application and contracting. The offer with the prices offered during the negotiation period expire in 24 hours. They can only vary if the reservation payment has been made and the conditions on which the offer was based do not change.

1.1.- Reservation procedure

YOUHOMEY establishes a different reservation method depending on the type of rental that the client is looking for and will be informed by our agents before making any payment.

YOUHOMEY establishes the payment of a reservation. This reservation must be satisfied to receive confirmation that the apartment is already reserved. The amount of the reservation may be different for each apartment and period.

As a guide, the reservation for apartments rented for months will be at least one month.

1.2.- Payment and collection methods

For online payment, YOUHOMEY uses secure card payment procedures through processes provided by Caixaban through Sermepa / Redsys that are integrated into our portals. You can consult the information of this provider at http://www.redsys.es

YOUHOMEY has different on-line payment systems, by credit card, STRIPE and bank transfer, the customer being the responsibility of all financial expenses that such payments entail.

1.3.- Receipt of documentation and rest of the rent

YOUHOMEY will send the client the contractual documentation and the account summary that must be satisfied upon entry and during the term of the contract. YOUHOMEY will maintain communication by email and will inform the client in writing of all the issues that have historically generated questions and / or controversy.

If the apartment is managed by YOUHOMEY or belongs to YOUHOMEY, the reservation, entrance and periodic payments will be made to YOUHOMEY directly.

1.4.- Rental rate payments

In some cases, normally in seasonal academic contracts, YOUHOMEY charges a fee to the client (+ VAT) for the collection of services provided and remote reservation. This rate will only be charged if the client finally hires an apartment.

1.5.- Change policy

YOUHOMEY cannot guarantee the availability of an apartment due to the client's request for change of dates.

If the request occurs for any reason that prevents your trip to Madrid, and after justifying it, YOUHOMEY undertakes to look for an alternative.

1.6.- Cancellation and / or no-show policy

The amount of the reservation is not refundable in case of cancellation.

1.7.- Time of entry and exit in the apartments

The client is obliged to communicate his arrival time to the apartment at least 3 days in advance. Given the diverse location of the accommodations, YOUHOMEY does not ensure the presence of its agent at the entrance or exit of the same if the client does not provide that information.

YOUHOMEY establishes a mandatory departure time from the apartment before 12pm, and an entry time from 16pm.

YOUHOMEY will only deliver the keys during business hours from 16:18 p.m. to 10:12 p.m., and will collect from XNUMX:XNUMX a.m. to XNUMX:XNUMX p.m. Any entry or exit from the apartments outside these hours will have an additional cost that our agents will have informed you by mail.

1.8.- Rent payment

Monthly rents must be paid from 1 to 5 of the month.

For contracts that do not start on the first day of the month, the amount paid as a reservation will be applied to the next full rental month, having to pay retroactively the amount corresponding to the proportion of the current month in the first five (5) days of the month next to your entry. Example: if your contract begins on October 15, the amount paid in your reservation will be applied as payment to the rent for the month of November, and in the first five (5) days of November you will pay the proportion of rent corresponding to the days from October 15 to 31. The following months you will pay the full rent as agreed in your contract.

1.9.- Hosted people

YOUHOMEY, depending on the type of contract, will offer different prices for each person staying in the apartment, giving authorization only and only to the number of people hired to stay overnight in the apartment.

If there is any additional need, the client is obliged to inform YOUHOMEY of the increase in the number of people.

In the event that more people than those authorized by YOUHOMEY stay overnight, the client must pay an additional individual apartment for each unauthorized person and night.

2.- PRIVACY POLICY

2.1.- Processing of personal data

In compliance with the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 we inform you that the data provided by you will be processed by FEDERAL NAJANAJANA SLU with CIF b88064050, with address in MADRID (MADRID), CP 28004, CALLE FERNANDO VI, Nº 17, 1 IZDA, in order to provide the requested and / or contracted service, carry out the billing thereof.

The legal basis for the treatment of your data is the execution of the service contracted and / or requested by you. The prospective offer of products and services is based on the consent that is requested, without in any case the withdrawal of this consent conditioning the execution of the contract.

The data provided will be kept as long as the commercial relationship is maintained or during the years necessary to comply with legal obligations. The data will not be transferred to third parties except in cases where there is a legal obligation.

You have the right to obtain confirmation about whether FEDERAL NAJANAJANA SLU is treating your personal data and therefore you have the right to exercise your rights of access, rectification, limitation of treatment, portability, opposition to the treatment and deletion of your data as well as the right to present a claim before the Control Authority by writing addressed to the aforementioned postal address or electronic "reservas@youhomey.com”Attached a copy of the DNI in both cases.

2.2.- Navigation information and cookies

All web pages owned by YOUHOMEY make use of tracking systems such as the use of cookies or plugins such as Google Analytics. YOUHOMEY's intention is to monitor customer behavior on the Web in order to improve our services and measure the degree of success of our designs.

Google Analytics, dependent on Google Inc., stores this information and makes it available to YOUHOMEY through its analysis tools. Neither Google nor YOUHOMEY will share unauthorized private information with third parties such as names or IP addresses that identify the client, but they do reserve the right to share the knowledge extracted from the navigation mode from the client's navigation on the web.

Given YOUHOMEY's need for this knowledge for its operation, the continuation of browsing our portals after the first screen accessed will be considered accepted from the data policy described at this point.

3.- LEGAL

3.1.- Type of contract

YOUHOMEY offers its clients only a seasonal contract of use other than permanent housing.

This contract is governed by the will of the parties, failing which, by the provisions of Title III LAU 1994 and, additionally, by the provisions of the Civil Code (arts. 1, 2.1, 3 and 4.3 LAU). In any case, and in accordance with the provisions of art. 4.1 LAU, the common provisions contained in Title IV (bond and formalization of the lease) and in Title V (lease processes) of the LAU will be mandatory.

3.2.- Invoices

All our prices for accommodation and our additional services include the VAT in force (as of June 2014, VAT exempt for housing contracts, 21% for the provision of services).

YOUHOMEY administers apartments of individuals who have no knowledge, capacity or interest in managing quarterly VAT returns and, therefore, do not accept business clients or self-employed clients who require an invoice and only admit individuals. It is the client's responsibility to inform in advance of their need for an invoice before making their reservation.

3.3.- Responsibilities

Neither YOUHOMEY nor the apartment owners will be liable for damages that may occur during your stay in the apartment, including without limitation, personal injury, death or loss, whether due to fire, theft or flood or due to action or the personal irresponsibility of the client, the unauthorized access of a person to the apartment or the misuse of the elements included in the accommodation.

In the event that you have a confirmed reservation and YOUHOMEY cannot accommodate you in the apartment of your choice, YOUHOMEY's responsibility will be limited to providing accommodation in an apartment with similar characteristics or to the full refund of the amounts paid.

At YOUHOMEY we strive to accurately describe our apartments. If any dispute arises regarding the description of the apartment, YOUHOMEY's responsibility will be limited to reimbursing the amounts paid, less the cost of the days spent, if you decide not to stay in the apartment.

3.4.- Conflict resolution

For any conflict over our services, Spanish law will be applied, from the Courts and Tribunals of Madrid, or the Madrid Court of Arbitration (Law 60/2003, of December 23, on Arbitration (BOE nº 309/12/2003) ).

4.- BEHAVIOR RULES

Our apartments are located in residential buildings. We demand that our guests behave appropriately. Don't make too much noise or make the music too loud. If the neighbors complain or if they have to call the police, you will have to vacate the apartment without the right to compensation or refund of the amounts paid for breach of contract. Remember that you are NOT allowed to carry out annoying or unhealthy activities, have parties or have pets without express authorization.

YOUHOMEY takes care of your apartments, they are cleaned before your arrival and after your departure. However, if the apartment is too dirty, we reserve the right to deduct from the Deposit / Deposit the amount necessary to cover the additional cleaning cost.

In some cases, normally contracts for months, we include a mandatory fee to cover the final cleaning of the apartment or room to prepare it for the next tenant.
